Tool 90: The State Complaint: Free, No Lawyer Required, Answer Due in 60 Days

THE RULE

Every state must run a written complaint system for violations of the Individuals with Disabilities Education Act (IDEA) (34 C.F.R. §§ 300.151-300.153). Any individual or organization may file - a parent, a grandparent, a teacher, an advocacy group, even someone from another state (34 C.F.R. §§ 300.151(a)(1), 300.153(a)). You do not need a lawyer, and filing costs nothing.

The complaint must be signed and in writing (34 C.F.R. § 300.153(a)). It must describe a violation that happened within the past year (34 C.F.R. § 300.153(c)). Once the state receives it, the state has 60 days to investigate and issue a written decision (34 C.F.R. § 300.152(a)). That deadline can stretch only in exceptional circumstances, or if both sides agree to pause and try mediation (34 C.F.R. § 300.152(b)(1)).

If the state finds a violation, it must fix it. The fix can include compensatory services - make-up help for what your child missed - or reimbursement of money you spent (34 C.F.R. § 300.151(b)(1)).

WHY IT MATTERS

This is the cheapest rung on the dispute ladder (Tool 88) that ends in a written decision - one the state must then see carried out (34 C.F.R. § 300.152(b)(2)). There is no hearing room, no cross-examination, no filing fee. You write down what happened, attach the paper, and the state investigates for you.

It is built for violations you can show on paper. Speech sessions written in the IEP but not delivered. A meeting held without you. Prior Written Notice never provided (Tool 26). An evaluation that blew past the deadline. For a child who lost months of services, the remedy is not an apology - it can be those services, made up, on a schedule.
