Tool 67: The Expedited Appeal: Discipline Timelines the District Hopes You Miss

THE RULE

If you disagree with a disciplinary change of placement, or with the manifestation determination, you can appeal by requesting a due process hearing (34 C.F.R. § 300.532(a)). This is not the ordinary due process track. The law makes it expedited: the hearing must occur within 20 school days of the date your complaint is filed. The decision is due within 10 school days after the hearing (34 C.F.R. § 300.532(c)(2)).

There is a catch, and it is the one parents miss. During the appeal, your child stays in the disciplinary setting - not the old classroom (34 C.F.R. § 300.533). That lasts until the hearing officer decides or the removal period runs out, whichever comes first, unless you and the district or state agree otherwise. The famous “stay put” rule (Tool 93) works differently in discipline cases. Filing does not press pause on the removal. Only speed helps.

The hearing officer has real power. If the removal broke the rules in 34 C.F.R. § 300.530, or the behavior was a manifestation of the disability, the officer can return your child to the placement the school removed them from (34 C.F.R. § 300.532(b)(2)(i)).

WHY IT MATTERS

Do the math with the school calendar in front of you. A 45-school-day removal is about 9 school weeks. The fastest possible appeal - 20 school days to a hearing, up to 10 more to a decision - is about 6 school weeks. If you file in week one, a decision can arrive with weeks of the removal left to undo. If you wait a month, the removal may be nearly over before anyone rules, and your child will have spent the whole stretch in the disciplinary setting.

The district’s lawyer knows this arithmetic. Delay costs the district nothing. It can cost your child every week the appeal might have recovered. This is one of the few places in this book where the deadline pressure runs entirely against you from day one.
