Tool 12: “She’s Passing, So She Doesn’t Qualify” - the Sentence That Answers It

THE RULE

Federal regulation says it directly: a child can be entitled to special education “even though the child has not failed or been retained in a course or grade, and is advancing from grade to grade” (34 C.F.R. § 300.101(c)(1)). The decision must be made for each child individually (34 C.F.R. § 300.101(c)(2)). The district’s duty to find and evaluate children reaches those suspected of a disability, even though they are advancing from grade to grade (34 C.F.R. § 300.111(c)(1)). And no single measure - including a report card - may be the sole basis for the decision (34 C.F.R. § 300.304(b)(2)).

The Supreme Court points the same direction. In Endrew F. v. Douglas County School District RE-1, 580 U.S. 386 (2017), the Court held that a child’s program must be reasonably calculated to enable “progress appropriate in light of the child’s circumstances,” and it rejected the idea that barely-more-than-nothing is enough. Grades are part of the picture. They are not the whole picture.

WHY IT MATTERS

A report card measures many things at once: effort, attendance, homework turned in, a teacher’s quiet accommodations, and your hours at the kitchen table every night. A B-minus earned with 3 hours of nightly help and a child who cries over homework is evidence of your labor, not proof there is no disability.

Children who struggle hardest to hide a disability are often the last to be evaluated, because their masking works - until it doesn’t. If “she’s passing” is allowed to end the conversation, the child pays for her own effort with years of waiting. The regulation exists for exactly this child.
