Letter 33: Request for Services During a Disciplinary Removal
When to Use It
Send this letter when removals pass 10 cumulative school days and another removal occurs. The district must provide services during each subsequent removal under 34 C.F.R. § 300.530(d)(4). The FBA and behavioral-services language in § 300.530(d)(1)(ii) applies to removals under § 300.530(c) or (g), not automatically to every short removal after day 10.
Who decides what the services are depends on the removal. If it is not a change of placement, school personnel decide, in consultation with at least one of your child’s teachers (34 C.F.R. § 300.530(d)(4)). If it is a change of placement, the IEP team decides (34 C.F.R. § 300.530(d)(5)). Either way, you are entitled to know what was decided. This letter asks for the plan in writing.
Send it to: the director of special education, with a copy to the principal.
