Letter 25: Request for Raw Progress-Monitoring Data

When to Use It

Send this letter when a progress report gives you words instead of numbers - “progressing gradually,” “improving with support” - or before any annual review, or any time you want to see the measurements behind the summary. The IEP must state how your child’s progress toward each annual goal will be measured and when reports will come (34 C.F.R. § 300.320(a)(3)). Your right to inspect and review education records reaches the raw material behind those reports: the probes, the data sheets, the work samples, and the scoring (34 C.F.R. § 300.613). And if an IEP meeting is coming, the district must comply with your records request without unnecessary delay and before that meeting (34 C.F.R. § 300.613(a)). Send it to: your child’s case manager or special education teacher, with a copy to the director of special education.
