Letter 24: Request for Restraint or Seclusion Incident Documentation
When to Use It
Send this letter promptly after you learn of an incident. IDEA does not create a general restraint or seclusion report deadline. State law or district policy may. Any document that is directly related to the child and maintained by the agency or a party acting for it is generally an education record subject to inspection (34 C.F.R. §§ 300.611(b), 300.613(a)). Ask for the records and preserve any video without claiming that every incident document or staff-training record must be produced under FERPA.
Speed matters here for one practical reason: school video systems overwrite on a schedule, and memories set fast. Ask in writing, at once, for everything.
Send it to: the principal and the director of special education. For a serious incident, copy the superintendent.
