When to Use It

Send this letter when the services on the IEP’s service grid - frequency, duration, location - are not happening in real life. Missed speech sessions, a resource room with no teacher, counseling that quietly stopped. A free appropriate public education means services provided in conformity with the IEP (34 C.F.R. § 300.17(d)), and the district must ensure services are made available in accordance with the IEP (34 C.F.R. § 300.323(c)(2)). An IEP the district wrote but does not follow is a promise on paper only.

Tool 24 explains why the frequency, duration, and location fields are what make a service enforceable. Attach your missed-session log - date, service, what happened, how you learned of it.

Send it to: the director of special education, with a copy to the principal.
