When to Use It
Send this letter when the district sets an IEP meeting for a time you cannot attend, or schedules one without asking you at all. You are not being difficult. The regulation requires the district to schedule the meeting “at a mutually agreed on time and place” (34 C.F.R. § 300.322(a)(2)). Your job in this letter is to be easy to say yes to: offer three real windows, offer a phone or video option, and ask for written confirmation. Tool 47 covers the short version for urgent situations.
Do not use this letter to stall. A parent who offers concrete dates promptly is exercising a right. A parent who is never available is handing the district a reason to meet without them (34 C.F.R. § 300.322(d)).
Send it to: the person who sent the meeting notice, with a copy to the director of special education. Email with a delivery or read receipt; keep a copy.
