Hearing Tool 42: The remedy you can actually get: matching the claim to the relief this forum can order

THE RULE

An impartial hearing officer decides the issues properly raised and may issue orders within the IDEA administrative forum. The federal regulation expressly preserves authority to order an LEA to comply with procedural requirements in 34 C.F.R. §§ 300.500 through 300.536, and New York expressly provides that an IHO-requested independent educational evaluation is at public expense (34 C.F.R. § 300.513(a)(3); 8 NYCRR § 200.5(j)(3)(viii)). Other requested relief must be tied to governing authority and supported by the pleaded claim and hearing record. The court-only remedial clauses in 20 U.S.C. § 1415(i)(2)(C)(iii) and 34 C.F.R. § 300.516(c)(3) are not the source of an IHO's authority.

Potential relief includes fact-specific compensatory education designed to remedy a proven denial (Application of a Student with a Disability, Appeal No. 25-280, official decision checked July 25, 2026; H-Tool 66); tuition reimbursement for a supported unilateral-placement claim (34 C.F.R. § 300.148(c); Burlington School Committee v. Department of Education, 471 U.S. 359 (1985); Forest Grove School District v. T.A., 557 U.S. 230 (2009); H-Tool 67); record-supported prospective CSE action or services that respect the CSE's statutory role (Application of a Student with a Disability, Appeal No. 25-184, official decision checked July 25, 2026; H-Tool 68); an IHO-requested independent educational evaluation at public expense (8 NYCRR § 200.5(j)(3)(viii); H-Tool 52); and an order requiring compliance with applicable procedural requirements (34 C.F.R. § 300.513(a)(3)). These are potential categories, not an automatic menu, and the precise form of any order remains claim-specific and record-specific.

Now the two hard limits, and they are the reason this tool exists. First, the IDEA administrative process does not provide compensatory damages for pain, distress, lost income, or other tort-like harm. See Luna Perez v. Sturgis Public Schools, 598 U.S. 142, 150 (2023). Any damages claim requires the separate claim, remedy, exhaustion, defendant, and limitations analysis in H-Tool 41. Second, an impartial hearing officer or State Review Officer does not award attorney fees. A court, in its discretion, may award reasonable fees to a parent who qualifies as a prevailing party under 20 U.S.C. § 1415(i)(3)(B) and 34 C.F.R. § 300.517(a) (H-Tool 73).

WHY IT MATTERS

Parents come in wanting justice, and justice in the abstract does not map onto the authority of an impartial hearing officer. A request to punish the district or compensate a family for stress and lost work seeks relief the IDEA administrative process does not provide. Keep those demands out of the hearing request and obtain claim-specific advice before pursuing them elsewhere.

The attorney-fee confusion is its own quiet loss. Parents assume that if they win, the hearing officer will make the district pay their lawyer. The hearing officer cannot. Fees come from a court, in a separate step, on separate rules (H-Tool 73), and a parent who does not know that can be surprised at the worst time, after a win, when the lawyer's bill is still theirs until a court says otherwise.

The point of naming the limits early is to aim the case. Compensatory education, reimbursement, prospective CSE action or services, an IHO-requested evaluation, and procedural compliance are potential forms of administrative relief when their governing standards and the record support them. Damages and attorney fees are not awards the IHO can make.
