Hearing Letter 23: THE HEARING CHRONOLOGY BUILT FROM THE IEPs
When to Use It
Your case is a timeline, and in an ordinary FAPE case the timeline is built from the district's own paper: the sequence of IEPs, the progress reports, the evaluations, and the report cards, read side by side. This form is that timeline. It holds one document to a line, and every line says what the document shows and what gap it reveals, so a feeling that "nothing changed for three years" becomes an exhibit a hearing officer can read down the page.
The measure you are reading against is the substantive FAPE standard. An IEP must be reasonably calculated to enable progress appropriate in light of the child’s circumstances (Endrew F. v. Douglas County School District RE-1, 580 U.S. 386, 399 (2017); Board of Education v. Rowley, 458 U.S. 176, 206-07 (1982)). The same annual goal copied forward, flat progress data, or a service reduction may be relevant evidence, but whether any one establishes a claim depends on the full record. Build the sheet from documents the district produced, not from memory.
