When to Use It
Use this letter when a witness you need will not commit to voluntary appearance at the hearing. D.C. hearing officers have no subpoena power; the only mechanism is an IHO-signed Notice to Appear, and you must request it at least 14 days before the hearing (ODR SOP § 409.D, checked August 13, 2026). The IHO signs within two business days of a proper request. Even signed, the Notice to Appear is enforceable only by a court, not by the hearing officer directly, so voluntary appearance is always the better first move.
