D.C. Letter 7: The Five-Business-Day Disclosure Cover Letter

When to Use It

Use this letter to accompany your disclosure package five business days before the hearing. D.C.'s disclosure rule is broader than the federal floor: it covers all evidence you intend to introduce, not just evaluations and recommendations, and it requires a witness list, filed with ODR as well as served on every other party (34 C.F.R. 300.512(a)(3), (b); ODR SOP § 504, checked August 14, 2026). If you retained an attorney, this letter is also where the attorney's financial-interest disclosure belongs.
