When to Use It
Use this letter after a favorable HOD or a favorable settlement, before filing the freestanding federal fee action D.C. requires (attorney fees are not awarded by the hearing officer; they require their own civil action, Moore v. District of Columbia, 907 F.2d 165). Use it also to invoke the $6,000 statutory expert-fee recovery, a right that exists only for complaints filed after July 1, 2016, and only through the court, not the hearing officer (D.C. Code 38-2571.03(7), checked August 13, 2026).
